Indirect or Consequential Loss and Indemnity

www.isleofwightscouts.org.uk or The Isle of Wight Scout Association will not be liable to the User or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). www.isleofwightscouts.org.uk or The Isle of Wight Scout Association will also not be liable for any failure to perform of its obligations under this Agreement caused by matters beyond its reasonable control.

The User will hold harmless any claims that arise against www.isleofwightscouts.org.uk or The Isle of Wight Scout Association from a breach of this agreement by themselves or any third party he or she authorises to use the service.

Limitation on Liability

No liability

The total liability of www.isleofwightscouts.org.uk and The Isle of Wight Scout Association is limited to the total subscription by the User over a twelve month period.

Changes to this Agreement

www.isleofwightscouts.org.uk reserves the right to change this Agreement from time to time, and post the new version on www.isleofwightscouts.org.uk website. When we do so, we will notify you that that there are changed terms and conditions by placing a note on the site (www.isleofwightscouts.org.uk). The new version of these terms and conditions will then take effect, and will govern all www.isleofwightscouts.org.uk services and your relationship with www.isleofwightscouts.org.uk:

Severability

In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.

Legal jurisdiction.

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

All personal information and details held on and processed by computers situated in the United Kingdom.

Disclosure of data by order of a Court and Security

We reserve the right to communicate a Member's personal information as we hold to third parties who are empowered by regulation, statute or order of a court.

We have security measures in place to protect our customer database. Access to this database is restricted internally. However, it remains each Member's responsibility:

  • to keep their password secret;
  • to protect against unauthorised access to your personel Details;
  • to log off from the www.isleofwightscouts.org.uk Service when not using it; and
  • to ensure against use by anyone else of the www.isleofwightscouts.org.uk Service through the machine that Member uses while they are "logged on" to the www.isleofwightscouts.org.uk Service
